What Cannot Be Revealed In Pre Employment Background Verification?
It is assumed by many that a pre employment verification procedure involves finding out more about an individual and the report could include every detail in the person’s life. This is a wrong interpretation of a background check. This is because most of us do know what is revealed in a reference check, but how many of us are aware of those records that cannot be revealed as a part of a background report? Till a person experiences or reads about a background screening himself he is not conversant with the actual processes and laws connected to it.
There are some records that need special permission from the record holder to access. We will learn about such records that are private and the laws associated with them here:
- School and College records:
A pre employment reference check consists of verifying the degrees and educational qualifications earned by a person, as mentioned on his resume. For doing this, the employer has to get a written consent from the student to access his educational records. This consent letter has to be produced at the school or university for gaining a view of the old files.
- Medical Records:
A person’s medical records are not made public like the bankruptcy he could have filed for. For getting a job, adequate education and experience are needed. But an employer can demand a look into the applicant’s medical history only if the job demands physical ability of some kind. Even in case of disabled people, if they can prove that they can carry out the piece of work given to them well, the employer cannot deny them the career opportunity, as per the law.
- Arrest Records:
A pre employment background verification report can specify arrests made only if they have resulted in a conviction or if the case is pending trial. Other minor arrests for speeding etc. need not affect the chance for getting a job.
Now jobseekers can rest assured that their pre employment background verification report will not mention anything like a past blind date or a minor argument with somebody at the night club! An important point to note is that the employer needs to have your signature on the disclosure for authorization, without which the reference check company cannot go ahead with the procedure.
